Summary:

Whereas, the City of Newark (City) is obligated to meet water quality and stormwater management goals as established in the City's Long Term Control Plan (LTCP), New Jersey Pollutant Discharge Elimination System (NJPDES) Permit No. NJ0108758, and New Jersey Department of Environmental Protection’s Tier A MS4 General Permit. The City of Newark Department of Water and Sewer Utilities (DWSU) intends to create Stormwater Source Control Systems (“GREEN INFRASTRUCTURE SYSTEMS”) at New Jersey Regional Day School as agreed upon by the Newark Board of Education (NBOE). Whereas, the City’s stormwater management goals and NBOE’s sustainability initiatives align, the GREEN INFRASTRUCTURE SYSTEMS will provide educational opportunities for students. Whereas, DWSU will be responsible for the design, review, approval, and construction, for the GREEN INFRASTRUCTURE SYSTEMS, including components of the infrastructure and associated costs. Whereas, NBOE will operate and maintain the agreed upon GREEN INFRASTRUCTURE SYSTEMS based on a maintenance protocol to be jointly developed between DWSU and NBOE specific to each GREEN INFRASTRUCTURE SYSTEM location. |

NOW THEREFORE BE IT RESOLVED, the Newark Board of Education will grant access to The City of Newark, Department of Water and Sewer Utilities, their consultants and contractors for the duration of planning, design, and construction. BE IT FURTHER RESOLVED, the Newark Board of Education agrees to operate and maintain the GREEN INFRASTRUCTURE SYSTEMS in perpetuity as property owner. the Newark Board of Education must notify the City of Newark, Department of Water and Sewer Utilities if 1) any modifications to the GREEN INFRASTRUCTURE SYSTEMS are planned, constructed or occur by otherwise unforeseen circumstances or 2) a change in property ownership is planned. |
