Summary: WHEREAS on August 30, 2017, the United States Department of Justice (“DOJ”) informed the Newark Public Schools (“NPS”) that it had opened an investigation into the School District’s policies and procedures for enrolling and registering English Language Learners and its practices for communicating with parents of students with Limited English Proficiency;
WHEREAS, in the course of its investigation, DOJ conducted site visits to the Family Support Center, Contact Center, other Central Office departments, and 13 NPS schools; requested and received voluminous documents and data; and interviewed numerous members of the District administration and staff;
WHEREAS DOJ has provided the results of its investigation and requested that the District take certain actions to comply with its EEOA obligations, as reflected in a proposed Settlement Agreement;
WHEREAS, upon recommendation of the Superintendent, the Board of Education finds that approval and authorization of the proposed Settlement Agreement is in the best interest of the Board, its schools and students;

Recommendation to the Board: NOW, THEREFORE, BE IT RESOLVED that the Board of Education hereby approves and authorizes the proposed Settlement Agreement with DOJ, subject to the Superintendent’s approval of specific terms, and authorizes the Board President to execute the Settlement Agreement on its behalf.
