Summary: WHEREAS, in response to the COVID-19 National Declaration of Emergency bids were electronically received on Friday, May 21, 2021 after public advertisement for Reading Materials, request for bids were issued to seventeen (17) vendors with four (4) vendors responding; and

WHEREAS, in accordance with N.J.S.A.18A:18A-5a(5), the District is authorized to award a contract without public advertisement for educational goods and services; and

WHEREAS, request for bids were publicly advertised as the District will utilize federal funds in excess of the federal simplified acquisition threshold; and

WHEREAS, the original contract was awarded to multiple vendors to provide requestors with a pool of reading material contractors at the May 27, 2021 Board meeting for a two (2) year period of May 21, 2021 through May 20, 2023 at an amount not to exceed two million five hundred thousand dollars ($2,500,000.00) annually; and

WHEREAS, the Newark Board of Education desires to amend the current contract increasing the award value from two million five hundred thousand dollars ($2,500,000.00) annually to five million dollars ($5,000,000.00) annually; and

WHEREAS, the recommendation for amendment of term contract has been reviewed and approved by Dr. Mary Ann Reilly, Assistant Superintendent of Teaching and Learning.

Recommendation to the Board: NOW THERE BE IT RESOLVED that the Newark Board of Education accepts and approves the amendment of term contracts for Reading Materials for a two (2) year period of May 21, 2021 through May 20, 2023 with the option to renew for one (1) additional two (2) year period from two million five hundred thousand dollars ($2,500,000.00) annually to five million dollars ($5,000,000.00) annually to the following vendors:

A. AKJ Wholesale / AKJ Education LLC, Baltimore, MD
B. Barnes and Noble Booksellers Inc., New York, NY (Various Locations)
C. Curriculum Associates LLC, North Billerica, MA
D. Follett School Solutions Inc., McHenry, IL

EXPLANATION: To provide the Newark Board of Education with a pool of reading material contractors. Subject to the availability of funds.
