Summary: WHEREAS Employee No. 16284 is a tenured teacher employed by the Board of Education of the City of Newark, County of Essex (the “Board”);
WHEREAS the Board withheld the salary increment of Employee No. 16284 for the 2020-2021 school year;
WHEREAS Employee No. 16284 challenged the increment withholding by filing a Petition with the Commission of Education, and the matter is currently pending in the Office of Administrative Law;
WHEREAS, subject to approval by the Board, the parties have resolved all matters in dispute by way of Settlement Agreement providing that Employee No. 16284 will retire, effective November 1, 2021, in exchange for the restoration of the salary increment withheld;
WHEREAS accordingly, Employee No. 16284 will submit a retirement letter effective November 1, 2021;
WHEREAS this settlement is in the best interests of the Board and the public, since it avoids an uncertain conclusion after protracted and costly proceedings at the expense of the public.

Recommendation to the Board: NOW THEREFORE, BE IT RESOLVED that the Board hereby authorizes and approves the settlement involving Employee No. 16284 with the terms as set forth above and authorizes the President to execute said Settlement Agreement on its behalf; and the Board authorizes and directs implementation of said Settlement Agreement in accordance with its terms.
