Summary: WHEREAS, in response to the COVID-19 National Declaration of Emergency bids were electronically received on Thursday, October 14, 2021, after public advertisement for Toilet Partitions and Related Supplies, bids were issued to forty-three (43) vendors with three (3) vendors responding, see award analysis; and

WHEREAS, in accordance with N.J.S.A. 18A:18A-4, the District shall award only by resolution of the board of education to the lowest responsive and responsible bidder after public advertisement for bids; and

WHEREAS, in accordance with N.J.S.A. 18A:18A-2(y), the bid submitted by Grainger is rejected and deemed unresponsive as this vendor failed to submit a signed bid; and

WHEREAS, the term of the contracts shall be for a two (2) year period commencing with date of award with the option to renew for one (1) additional two (2) year period; and

WHEREAS, the recommendation for award of term contracts were reviewed and approved by Lisa Abdul, Management Specialist and Vincent Hutcheson, Director of Project Control.

Recommendation to the Board: NOW THEREFORE BE IT RESOLVED, that the Newark Board of Education hereby accepts and approves the award of term contracts for Toilet Partition and Related Supplies for a two (2) year period commencing with date of award with the option to renew for one (1) additional two (2) year period as follows:

Benco, Inc. Fairfield, NJ 23 items at an annual cost not to exceed $111,669.54
Modulex Partitions Corp. Hillside, NJ 9 items at an annual cost not to exceed $28,512.00
Total annual award at a cost not to exceed $140,181.54
